Renewals And Terminations Of A Franchise Business

Renewal of the Contract : Any American franchise business agreements are valid for a limited time only, and such valid time period is mention in the franchise agreement. At the end, of the current period both franchisers and franchisee has right to continue to run the business or not. The franchiser and franchises may agree to revalidate the old contract or write a new contract with modified the terms and condition etc. There is no guarantee from the franchiser, that the business franchise contract will be renew at the end of the term and at a same the there is no obligation to the franchisee to continue to do business with same franchisor. There are some causes however these are the comments reasons why the franchising business agreements will be canceled or terminated at the end of the renewal.
Renewal Fee : The franchise will charge a one time lump sum fee to renew or re write the franchise agreement. Both parties can negotiate for the contract terms and conditions and the franchisee has to pay the renewal fee and such fee will be set by the franchiser and this will be on time fee valid for the new contracting period. Both parties have right to negotiate for the new terms and conditions for all matters concerning the franchising business. Some franchisers may not charge the renewal fee to encourage the operators or giving an incentive to the operators, hence this is the sole discretion of the franchiser weather to charge or not and even if they charges how much etc will be decided by the franchiser
Early Termination Fee / Liquidated Damages Fee : This is one time fee if the franchisee decides not to do run the franchising business with termination franchising business agreement before the end of the agreed period, the franchiser has to right to charge the fee of Early Termination or Liquidated damages fee. This is a one time and the amount fee will be varying from the franchiser to franchiser.
